What terms and conditions are published on this page?
This page carries the full terms and conditions for the Selleys Chance To Win $100K Cash Promotion — a game of chance that opened at 12:00am AEDST on 26 February 2024 and closed at 11.59pm AEST on 10 April 2024. That promotion has closed. Nothing on this page constitutes a current offer, and the competitions and giveaways page states that there are currently no competitions or giveaways running.
What follows is an orientation to what the published terms actually say, so you can find the clause you need without reading twenty pages of legal text. Where a promotion is running in future, its own terms will govern it — the detail below is specific to the 2024 promotion.
Who the promoter is
The promoter named in the terms is Selleys, a division of DuluxGroup (Australia) Pty Ltd (ABN 67 000 049 427), of 1956 Dandenong Road, Clayton, 3168, Australia.
The promotion was authorised under NSW Authority No. TP/00158/, ACT Permit No. TP 23/02683 and SA Licence No. T23_2069.
Who could enter
- Australian resident individuals aged 18 years or over.
- For purchases made in Australia from a participating Mitre 10, Home Timber and Hardware, Thrifty-Link or True Value Hardware store. Participating stores displayed promotional material; entrants in doubt could ask the store directly.
- Employees of the promoter and of agencies associated with the promotion, and their immediate families, were ineligible. "Immediate family" is defined broadly in the terms, extending to first cousins.
- The promoter determined eligibility in its absolute discretion.
How entry worked
- Spend $15 or more including GST in a single transaction on any Selleys branded product at a participating store — the qualifying purchase.
- Visit www.selleys.com.au and follow the prompts to the promotion page.
- Complete the online entry form: full name, postal address, email address, mobile phone number, the store where the purchase was made, whether a Selleys Pro-Trade PU product was purchased, and a legible copy of the purchase receipt.
- Agree to the terms and conditions and submit.
Receipts had to be uploaded in pdf, jpg, png or heic format and could not exceed 5 MB. Multiple entries were permitted, but only one entry per qualifying purchase regardless of how far the spend exceeded $15, and each entry had to be submitted separately.
Bonus entry: purchasing a participating Selleys Pro-Trade PU product as part of the same qualifying transaction earned an additional entry in the prize draw.
Proof of purchase — the clause that invalidated the most entries
The terms are unusually specific here, and worth reading if you ever enter a promotion of this kind. Entrants had to retain the original purchase tax invoice for every entry submitted. The receipt had to clearly show the store of purchase, the value of the purchase, that eligible products were bought, the quantity of eligible products, the date of purchase and the receipt number, and had to be a valid Australian tax invoice as defined by the ATO.
An incomplete, illegible or missing receipt made the entry invalid, and failure to produce proof of purchase on request could — at the promoter's absolute discretion — invalidate all of an entrant's entries. Participating stores were not obliged to supply duplicate receipts.
How the prize was decided
The promotion ran in two stages.
Stage one — the major prize draw. A random electronic draw took place at Switch Marketing, 6 Hodgson Street, Kew VIC 3101, at 2:30pm AEDT on 16 April 2024. The first valid entry drawn won the major prize. The winner was to be notified by phone and email within two days and their name published on www.selleys.com.au on 22 April 2024. Reserve entries could be drawn in case an invalid entry or ineligible entrant came out.
Stage two — the contingency game. The drawn participant then played a game at the participating store where the qualifying purchase was made, at 12:00pm AEDT on 31 May 2024. Seventeen envelopes were divided into three groups: two in Group 1, five in Group 2 and ten in Group 3. One envelope in each group carried a message representing the A$100,000 major prize; the rest carried a message representing A$3,000 cash.
The attendee chose one envelope from each group. Selecting the $100,000 message in all three won A$100,000, subject to verification by the judges. Selecting a consolation message at any group ended the game and won A$3,000 cash, paid within 28 days. Either amount was paid by direct debit to the winner's nominated bank account.
The participant had to respond to the winner notification by 12:00pm AEDT on 13 May 2024 to attend. A proxy aged over 18 could be appointed in writing; if the promoter could not make contact before the game, a promoter representative played on the participant's behalf. Where travel was restricted by public health orders, the participant could take part by Zoom.
Prize pool and claim dates
- Total prize pool: up to A$100,000.
- Prize had to be claimed by 11:59pm AEDT on 23 August 2024.
- An unclaimed prize draw, if needed, was set for 30 August 2024 at the same place as the original draw, with notification by phone and email within two business days.
- Costs of attending the game were the participant's responsibility, and winners were advised that tax implications may arise and to seek independent financial advice before accepting a prize.
The general clauses
The remainder of the page is standard promotional terms: the promoter's decision is final and no correspondence is entered into; incomplete or indecipherable entries are invalid; automated entry software is prohibited; the promoter may verify identity, age and residence, and may disqualify entrants who tamper with the entry process or behave abusively; prizes are not transferable or exchangeable unless stated; unavailable prizes may be substituted with one of equal value subject to regulatory direction; and liability is excluded to the extent the law allows, without affecting non-excludable rights under the Competition and Consumer Act 2010.
Entrants assigned intellectual property in submitted images to the promoter and consented to the use of a winner's name, likeness, image and voice in promotional media. The promotion was not sponsored, endorsed or administered by Facebook, LinkedIn or Instagram, even where advertised on those platforms.
Privacy
The promoter collects personal information in order to conduct the promotion and may disclose it to related bodies corporate, contractors and third parties required to provide the prize. Entry was conditional on providing that information. The promoter is bound by the Australian Privacy Principles in the Privacy Act 1988 (Cth). The full privacy policy sets out how personal information is handled, and requests to access or update personal information go to the promoter's office.
